Terms of Service

1. Agreement to Terms

By submitting an inquiry, entering into a service agreement, or otherwise engaging with Costa Scales ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Costa Scales is a digital marketing agency based in Woodbridge, Ontario, Canada, operated by Tristan Da Costa.

2. Services

Costa Scales provides digital marketing services including but not limited to:

• Meta (Facebook and Instagram) advertising campaign management
• Google Ads campaign management
• Social media content creation and management
• Marketing strategy consulting

The specific services provided to each client are outlined in a separate service agreement or proposal document agreed upon before work begins.

3. Payment Terms

Monthly retainer fees are due at the start of each billing cycle. Ad spend budgets are managed separately and paid directly to the advertising platforms (Meta, Google). Costa Scales does not mark up or take a percentage of your ad spend.

Invoices not paid within 7 days of the due date may result in services being paused until payment is received.

4. No Contracts and Cancellation

Costa Scales operates on a month-to-month basis with no long-term contracts. You may cancel services at any time with 30 days written notice. No refunds are provided for the current billing period upon cancellation.

Costa Scales reserves the right to terminate a service agreement at any time if a client violates these terms or engages in conduct that is harmful, illegal, or contrary to our values.

5. Results and Guarantees

Digital advertising results vary depending on many factors including industry, competition, budget, and market conditions. Costa Scales does not guarantee specific results, lead volumes, or return on ad spend. We commit to applying our best effort, experience, and strategy to achieve the best possible outcomes for your business.

6. Client Responsibilities

To deliver effective services, clients agree to:

• Provide accurate information about their business, products, and services
• Grant necessary access to advertising accounts and platforms
• Respond to communications in a timely manner
• Not engage in or request advertising that violates platform policies or applicable laws

7. Intellectual Property

Ad creative, copy, graphics, and other materials created by Costa Scales for your campaigns remain the property of your business upon full payment. Costa Scales retains the right to reference completed work in our portfolio unless you request otherwise in writing.

8. Limitation of Liability

Costa Scales shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to lost profits, lost data, or business interruption. Our total liability to any client shall not exceed the total fees paid in the three months preceding the claim.

9. Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

10. Changes to Terms

We reserve the right to update these Terms of Service at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. We will notify active clients of material changes via email.
